By completing a request for competitive quotes for title insurance or  an application to become a Member, you represent and warrant that the  information provided therein is complete and accurate in all respects.  Tileinsurance.com retains the right, in its sole discretion to reject  any application for TitleInsuranceOnline.com membership or to not forward to  Members any inquiry for title insurance which it deems non-credible.  By becoming a Member, you warrant and represent that every quote you  provide to every Inquirer will be fair and accurate and include all  applicable and pertinent charges, and otherwise in compliance with all  applicable State and Federal Laws. In the event that certain charges  are intentionally omitted or assumptions are made in order to provide  said quote, such omissions or assumptions must be prominently displayed  and disclosed to the Inquirer at the time of delivery said quote. Fees for the Service  TitleInsuranceOnline.com offers subscriptions to title insurance agencies and  underwriters on a per county basis within the United States.  Members pay a monthly membership or subscription fee for the right to  receive leads, via email, on inquires for title insurance by Inquirers  for properties located in the counties in which such Members have  subscribed to. It is then up to each Member to communicate directly  with each Inquirer and provide a complete and accurate quote for title  insurance and related closing fees. Inquirers should be aware that  Members are motivated to provide quotes for the purpose of gaining the  Inquirers business.  TitleInsuranceOnline.com is free to Inquirers. TitleInsuranceOnline.com does not  receive any fees or additional compensation for title insurance  policies sold by any Member or purchased by any Inquirer. Any notice to an Inquirer or Member shall be  given to the name and address provided to TitleInsuranceOnline.com  Indemnification  Each Member agrees to indemnify, defend, and hold harmless  TitleInsuranceOnline.com, LLC, its officers, directors, employees, agents,  licensors and third party suppliers from and against all losses,  expenses, damages and costs, including reasonable attorneys' fees and  court costs, resulting from any violation of these Terms and  Conditions.  Jurisdiction  Any claim relating to the Web Site or your use of it shall be governed  by the internal substantive laws of the State of Florida, without  regard to its conflict of laws provisions, and you agree that  jurisdiction and venue in any legal proceeding directly or indirectly  arising out of or relating to this Web Site shall be in the state or  federal courts located in Florida, Florida. The parties  shall, within thirty (30) days of such demand for arbitration, select a  mutually agreeable arbitrator and submit the dispute to such arbitrator  for binding arbitration, through the Palm Beach County American  Arbitration Association Regional Office, under the Commercial  Arbitration Rules of the American Arbitration Association. If the  parties are unable to agree upon an arbitrator, the arbitrator shall be  appointed in accordance with the rules and procedures of the American  Arbitration Association. The arbitration fee shall be paid or  reimbursed by the non-prevailing party, as determined by the  arbitrator, who shall also award appropriate attorneys' fees and costs  to the prevailing party  Modification of these Terms of Agreement  TitleInsuranceOnline.com reserves the right to change the terms, conditions,  and notices under which this Web Site is offered, and your use of the  Web Site following any such changes shall be deemed to constitute your  consent to such modified Terms of Agreement. You agree to regularly  review these Terms of Agreement to verify whether they have been  changed.  Termination  Anything contained in this agreement, or among the Web Site or within  its marketing materials notwithstanding, TitleInsuranceOnline.com retains the  right, in its sole discretion, to cancel or otherwise terminate the  membership of any and all Members at any time for any reason  whatsoever. In such case, TitleInsuranceOnline.com’s sole responsibility  shall be to refund a pro-rata amount of any pre-paid subscription fees  to each such Member.
